This Privacy Policy explains how Tervoa INC ("we," "us," or "our") collects, uses, discloses, and protects information about you when you visit tervoa.com (the "Site"), create an account, place an order, contact us, or otherwise interact with us. It applies to all visitors, customers, and users of the Site.

By using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

1. Information We Collect

Information you provide to us. When you use the Site, you may provide us with information directly, including:

  • Contact and account details, such as your name, email address, shipping and billing addresses, telephone number, and username and password for your account;
  • Order information, including the products you purchase, order numbers, and transaction history;
  • Payment information, which is collected and processed by our third-party payment providers. We do not store full credit or debit card numbers, CVV codes, or related authentication data on our servers;
  • Communications, including messages you send through our "Contact Us" form, emails, chat, and other inquiries, as well as your preferences;
  • User content, such as product reviews or other submissions you choose to post; and
  • Other information you voluntarily provide to us.

Information we collect automatically. When you visit the Site, we and our service providers may automatically collect certain information about your device and usage, including:

  • Device and browser information, such as IP address, browser type and version, operating system, language preferences, and screen resolution;
  • Usage data, such as pages viewed, referring URLs, time spent on the Site, clicks, and the dates and times of your visits; and

2. How We Use Your Information

We may use the information we collect for the following purposes:

3. Legal Bases for Processing (European Economic Area Users)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, our processing of your personal data is based on the following legal bases: (a) performance of a contract with you (for example, to fulfill an order); (b) our legitimate interests, which are not overridden by your rights (for example, to improve our Site and prevent fraud); (c) compliance with a legal obligation; and (d) your consent, where we have requested it and where you have the right to withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal.

4. Cookies and Similar Technologies

We and our service providers use cookies, pixels, and similar technologies to operate and improve the Site, remember your preferences, understand how visitors use the Site, and for security. Cookies fall into the following categories:

  • Strictly necessary cookies, which are required for the Site to function, including shopping cart, checkout, and account authentication features;
  • Functional and preference cookies, which remember choices you make, such as your language and region;
  • Analytics cookies, which help us understand how the Site is used so we can improve it; and
  • Marketing cookies, which may be used (only where you consent) to measure the effectiveness of our advertising and to show you relevant offers.

You can control or delete cookies through your browser settings. Most browsers let you refuse cookies or alert you when a cookie is placed. Please note that if you disable cookies, some features of the Site, including checkout, may not function properly.

5. How We Share Your Information

We do not sell, rent, or trade your personal information. We do not "share" personal information for cross-context behavioral advertising as defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"). We may disclose your information to the following categories of recipients for the purposes described in this Policy:

  • Service providers, such as payment processors, shipping and fulfillment carriers, fraud-prevention providers, analytics providers, IT and hosting providers, and customer-support tools, who process information on our behalf and are contractually required to protect it;
  • Payment processors, who handle your payment data in accordance with applicable security standards such as PCI DSS;
  • Business and legal partners, where necessary to operate our business or as required or permitted by law;
  • Legal and safety purposes, when we believe in good faith that disclosure is required to comply with a law, regulation, subpoena, court order, or other legal process, or to protect the rights, property, or safety of our users, the public, or ourselves;
  • Business transfers, in connection with a merger, sale, acquisition, reorganization, bankruptcy, or other transfer of all or part of our business or assets, in which case your information may be among the assets transferred; and
  • Other parties with your consent or at your direction.

We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

6. Third-Party Services and Links

The Site may contain links to third-party websites, applications, and services that are not operated by us. This Privacy Policy does not apply to those third parties. We are not responsible for the privacy practices of any third party, and we encourage you to review the privacy policies of any third-party service you visit or use.

7. Advertising and Analytics

We may use analytics services, such as website analytics tools, to collect and analyze usage information. We do not currently engage in interest-based advertising, but if we do so in the future, we will update this Policy and, where required by applicable law, obtain your consent before placing advertising cookies or sharing information for cross-context behavioral advertising.

8. Marketing Communications and Your Choices

If you opt in to receive marketing communications, such as promotional emails, we may contact you with news, offers, and product information. Consistent with the U.S. CAN-SPAM Act, every marketing email we send will include a clear way to opt out of future messages (such as an "unsubscribe" link). You may also opt out at any time by contacting us at info@tervoa.com. Transactional messages (such as order and shipping confirmations) are not marketing communications and will continue to be sent even if you opt out of marketing, to the extent permitted by law.

9. Data Security

We implement reasonable and appropriate technical, administrative, and organizational measures designed to protect your personal information against unauthorized access, loss, alteration, or destruction. These measures include encryption in transit, access controls, and secure hosting. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of your information.

10. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, including to provide our products and services, maintain accounts and order records, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When we no longer need your information, we will delete or anonymize it, unless retention is required or permitted by law.

11. Children's Privacy

Our Site and services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 in violation of the U.S. Children's Online Privacy Protection Act ("COPPA"). If you are a parent or guardian and believe that your child has provided us with personal information, please contact us at info@tervoa.com, and we will take steps to delete such information promptly.

12. Your Privacy Rights

Depending on where you live, you may have the following rights with respect to your personal information:

  • The right to know what personal information we have collected about you and how it is used and shared;
  • The right to access a copy of your personal information;
  • The right to correct inaccurate personal information;
  • The right to delete personal information we have collected about you, subject to certain legal exceptions;
  • The right to opt out of the "sale" or "sharing" of your personal information. As noted above, we do not sell or share your personal information;
  • The right to limit the use of sensitive personal information, where applicable;
  • The right to non-discrimination, meaning we will not deny goods or services, charge different prices, or provide a different level of service because you exercised a privacy right; and
  • The right to appeal a decision we make in response to a request, where provided by applicable law.

California residents. If you are a California resident, the CCPA/CPRA provides you with the rights described above. For purposes of the CCPA/CPRA, we collect the following categories of personal information: identifiers (such as name, contact details, and account information); commercial information (such as order and transaction records); internet or other electronic network activity (such as browsing and usage data); and inferences drawn from any of the above. We do not sell or share personal information and do not have actual knowledge that we sell or share the personal information of minors under 16. We will not discriminate against you for exercising your CCPA/CPRA rights. California's "Shine the Light" law also permits California residents to request, once per calendar year, certain details about how we share their personal information with third parties for direct-marketing purposes; as we do not engage in that type of sharing, no such disclosure is required.

Other U.S. state residents. Residents of states with comprehensive consumer privacy laws, including Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and Utah (UCPA), and residents of Nevada (under the Nevada Privacy of Information Collected on the Internet from Consumers Act), may have rights to access, correct, or delete personal information and to opt out of certain processing, as described above.

How to exercise your rights. To submit a request, email us at info@tervoa.com. We will verify your identity before responding. Depending on the request, we may need to confirm details such as your name, email address, or recent order information. You may designate an authorized agent to make a request on your behalf by providing written authorization, and we may ask the agent to verify your identity. We will respond to verified requests within the time frame required by applicable law. If we decline your request, you may have the right to appeal our decision by replying to our response.

13. Do Not Track and Global Privacy Control

Some browsers transmit "Do Not Track" (DNT) signals. Because there is not yet a common standard for how websites should respond to DNT signals, our Site does not currently respond to DNT signals. We do, however, honor Global Privacy Control (GPC) signals for California residents, which operate as a request to opt out of the sale or sharing of personal information.

14. International Data Transfers

Your information may be processed and stored in the United States and in other countries where we or our service providers operate. When we transfer personal information across borders, we take steps to protect it, including through appropriate safeguards required by applicable law.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this Policy. If we make material changes, we will provide notice through the Site or by other means, such as email, before the changes become effective. Your continued use of the Site after the revised Policy is posted constitutes your acceptance of the changes.
